Article 1: Definitions

In these general terms and conditions, the following definitions apply:

Entrepreneur:
Candy Company, trading under the name Mr Snoep, a sole proprietorship established at Jelle Zijlstraweg 204, 1689 ZX Zwaag, registered with the Chamber of Commerce under number 95541748, VAT number NL005160287B23.

Consumer:
The natural person who does not act in the exercise of a profession or business.

Distance agreement:
An agreement concluded via www.mrsnoep.nl without physical presence of the parties.

Reflection period:
The period of 14 days within which the consumer can exercise the right of withdrawal.

Right of withdrawal:
The consumer's right to cancel the agreement within the reflection period.

EU countries:
Member states of the European Union where delivery is possible.

Article 3: Applicability

  1. These general terms and conditions apply to every offer and every agreement between entrepreneur and consumer.

  2. The agreement is exclusively concluded with consumers (B2C).

  3. If the consumer resides in another EU country, the mandatory consumer rights of that country remain applicable.

Article 4: The offer

  1. The offer contains a complete and accurate description of the products.

  2. Images are indicative; color deviations do not entitle to cancellation.

  3. Apparent errors or mistakes do not bind the entrepreneur.

  4. All prices include VAT according to the OSS scheme and exclude shipping costs unless otherwise stated.

Article 5: The Agreement

  1. The agreement is concluded at the moment of ordering and successful payment.

  2. Mr Snoep may refuse an order in case of incorrect information, payment problems, or suspicion of misuse.

  3. The consumer receives an order confirmation by email.

Article 6: Right of Withdrawal

The consumer has the right to dissolve the agreement within 14 days without giving reasons.

The reflection period starts the day after receipt of the product.

The consumer must notify within 14 days that they wish to withdraw and then return within 14 days.

Refunds will be made within 14 days after receipt of the return shipment or proof of dispatch.

Article 7: Exclusion of Right of Withdrawal

The right of withdrawal is excluded for:

  1. Products that spoil quickly or have a limited shelf life, including candy and other foodstuffs.

  2. Sealed products that cannot be returned for hygienic or food safety reasons and whose seal has been broken.

  3. Products that are specially made to measure or personalized, such as personalized candy mixes.

Article 8: Prices

  1. All prices include VAT.

  2. VAT is calculated according to the OSS scheme depending on the country of delivery.

  3. Printing and typographical errors are reserved.

Article 9: Delivery

  1. Delivery takes place at the address provided by the consumer within the European Union.

  2. Delivery times are indicative.

  3. The risk passes to the consumer at the moment of delivery.

  4. Mr Snoep is not liable for delays caused by carriers.

  5. If a product is not available, the consumer will be informed and a refund will be made.

Article 10: Conformity

The entrepreneur guarantees that the products comply with the agreement and applicable EU food safety legislation.

Complaints about defects must be reported within a reasonable period.

Article 11: Payment

  1. Payment is made in advance via the offered payment methods.

  2. The order will only be shipped after successful payment.

  3. In case of fraud or misuse, the order may be canceled.

Article 12: Complaints Procedure

  1. Complaints can be submitted via klantenservice@mrsnoep.nl.

  2. The entrepreneur responds within 14 days.

  3. Consumers within the EU can use the ODR platform via https://ec.europa.eu/consumers/odr

Article 13: Disputes and Applicable Law

  1. These terms and conditions are governed by Dutch law.

  2. If the consumer resides in another EU country, they may also invoke mandatory consumer legislation of their own country.

  3. The Vienna Sales Convention is excluded.

Article 14: Final Provisions

If any provision is found to be invalid, the remaining provisions shall remain in effect.
